Please read these Terms and Conditions (“Terms”) carefully before using the Cruise platform operated by Tuners Cafe (“we”, “us”, “our”). During account setup you will be asked to confirm you have read and agree to these Terms and our Privacy Policy before you can use the App — this is a condition of account creation, not just a formality.
If you do not agree, do not use the App.
1. Who We Are
Tuners Cafe operates the Cruise platform, available at tunerscafe.com and through the Cruise mobile web application (“the App” or “Cruise”). Contact us at cruise@tuners.cafe.
2. Eligibility
You must be at least 13 years old to use Cruise. We ask for your date of birth when you set up your account and will not let you continue if you tell us you are under 13.
If you are 13, 14, 15, 16, or 17, you may only use Cruise with the permission of a parent or legal guardian. During account setup we ask you to confirm that permission has been given. We do not independently verify this — it’s a self-declaration, and a parent or guardian who believes their child is using Cruise without permission should contact us at cruise@tuners.cafe so we can review the account.
We reserve the right to refuse or suspend access to any person at any time, including where we have reason to believe the age or guardian-consent information provided is inaccurate.
3. Your Account
3.1 Registration
You may sign in using Google, a phone number, or an email magic link. You are responsible for maintaining the security of your sign-in credentials and for all activity that occurs under your account.
3.2 Accurate information
You agree to provide accurate, current, and complete information when creating your account and to keep it up to date. Providing false information — including registering vehicles you do not own or have never owned — is a violation of these Terms.
3.3 Account suspension and termination
We may suspend or terminate your account at any time if we believe you have violated these Terms, engaged in fraudulent activity, or acted in a way that harms other users or the platform. Where possible we will notify you of the reason.
You may request deletion of your account at any time from within the App (Profile → Delete my account), or by contacting us at cruise@tuners.cafe. Requesting deletion queues your account for removal; we aim to complete it within 30 days, in line with the erasure rights described in our Privacy Policy.
4. The Garage (Vehicle Registration)
4.1 Vehicle data
When you add a vehicle using its UK registration mark, we query the DVLA Vehicle Enquiry Service to retrieve publicly available data about that vehicle. You agree not to use the garage feature for any purpose other than managing your personal vehicle history.
4.2 Ownership status
You may mark vehicles as current, previous, aspiring, or future. These statuses are self-declared and do not constitute legal proof of ownership. We do not verify ownership.
4.3 AI-generated images
Vehicle imagery displayed in the App may be generated by artificial intelligence. These images are illustrative only and may not accurately represent any specific vehicle.
5. Events
5.1 Proposing events
Any registered user may propose a car event. Proposed events are reviewed by our moderation team before being published. We reserve the right to reject, unpublish, or modify any event at our discretion.
5.2 Your responsibilities as an organiser
If you propose an event, you are responsible for ensuring the information you provide is accurate and that you have the authority to list the event. Tuners Cafe is not responsible for any event you organise and is not a party to any arrangement between you and attendees.
5.3 Event research
When you provide a URL during event creation, we fetch content from that page to assist with populating event details. You warrant that providing that URL does not violate any third-party terms of service or intellectual property rights.
5.4 Attendance
Marking yourself as attending an event is an expression of interest only. It does not guarantee admission, and we accept no liability for any event you attend or attempt to attend.
6. Chats
6.1 Acceptable use
When using chat, events, and any other space where you interact with other members, you agree to follow our Community Guidelines, which are incorporated into these Terms by reference. In summary, you agree not to post content that is:
- Unlawful, abusive, threatening, harassing, or discriminatory
- Sexually explicit or violent
- Spam or commercial solicitation
- Designed to impersonate another person
- In violation of any third party’s intellectual property or privacy rights
6.2 Profanity and moderation
All messages are automatically analysed for profanity. Messages containing profanity will be stored in a censored form visible to other users. Repeat violations result in automated warnings and may result in suspension from chat or full account suspension.
6.3 Message retention
Messages are retained on our servers and may be reviewed by our moderation team for the purposes of enforcing these Terms. By sending a message you grant us a non-exclusive licence to store and display that content to members of the chat.
6.4 No guarantee of permanence
We may delete messages at our discretion, including as a result of a moderation action or account deletion.
7. Kudos
Kudos are a reputation and engagement metric within Cruise. They have no monetary value and cannot be exchanged for cash, goods, or services. We reserve the right to award, adjust, or revoke Kudos at any time without notice.
8. Subscriptions and Payments
8.1 Free tier
Core features of Cruise are available without charge. We reserve the right to introduce, change, or remove features from the free tier at any time.
8.2 Paid plans
Premium features are available via subscription. Prices, features, and billing cycles are described within the App at the time of purchase. All payments are processed by Stripe. By subscribing you agree to Stripe’s terms of service.
8.3 Billing
Subscriptions are billed at the start of each billing period. If payment fails, access to premium features may be suspended until payment is resolved. You may cancel your subscription at any time; cancellation takes effect at the end of the current billing period.
8.4 Refunds
Except where required by applicable law, subscription payments are non-refundable.
9. Intellectual Property
9.1 Our content
All content, design, code, and materials within Cruise — including logos, graphics, and AI-generated vehicle images — are owned by or licensed to Tuners Cafe. You may not copy, reproduce, or distribute any part of the App without our prior written consent.
9.2 Your content
You retain ownership of any content you create within the App (event descriptions, messages, etc.). By submitting content you grant us a worldwide, royalty-free, non-exclusive licence to store, display, and moderate that content for the purpose of operating the platform.
You warrant that any content you submit does not infringe the rights of any third party.
10. Privacy
Your use of Cruise is also governed by our Privacy Policy, which is incorporated into these Terms by reference. By using Cruise you also agree to the Privacy Policy.
11. Disclaimers and Limitation of Liability
11.1 As-is service
Cruise is provided “as is” and “as available” without warranties of any kind, either express or implied. We do not warrant that the App will be uninterrupted, error-free, or free of harmful components.
11.2 Vehicle information
Vehicle data displayed in the App is sourced from the DVLA and is provided for informational purposes only. We do not guarantee its accuracy and accept no liability for any reliance placed on it.
11.3 Events
We are not responsible for the accuracy of event information, the conduct of event organisers or attendees, or any loss or injury arising from your attendance at any event.
11.4 Limitation of liability
To the fullest extent permitted by law, Tuners Cafe’s total liability to you for any claims arising from your use of Cruise shall not exceed the total amount you have paid us in the 12 months preceding the claim, or £50 — whichever is greater.
Nothing in these Terms limits our liability for death or personal injury caused by our negligence, fraud, or any other matter that cannot be excluded by law.
12. Indemnity
You agree to indemnify and hold harmless Tuners Cafe and its officers, employees, and partners from any claims, damages, losses, or costs (including legal fees) arising from your use of the App, your violation of these Terms, or your infringement of any third-party rights.
13. Third-Party Services
The App integrates with third-party services including Google, Stripe, the DVLA, and OpenAI. Your use of those services is subject to their respective terms of service. We are not responsible for the availability, accuracy, or conduct of any third-party service.
14. Changes to These Terms
We may update these Terms from time to time. When we do, we will update the “Last updated” date and version number at the top of this page. For material changes, we will ask you to re-confirm your agreement in the App before you can continue using it; for minor changes, continued use after the change is posted constitutes your acceptance.
15. Governing Law
These Terms are governed by the laws of England and Wales. Any disputes arising from these Terms or your use of the App shall be subject to the exclusive jurisdiction of the courts of England and Wales.
